These Terms of Service ("Terms") govern your access to and use of gbpranktracker.com (the "Service"), operated by GBP Rank Tracker ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, purchasing credits, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Creation

To use certain features of the Service, you must create an account by signing in with Google OAuth. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials and not share access with unauthorized parties.
• Be responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Credit Purchases and Refunds

3.1 Purchasing Credits

The Service uses a pay-per-scan credit model. You may purchase credits at any time through our Stripe-powered payment system. Credits are added to your account balance immediately upon successful payment. All prices are in US Dollars (USD).

3.2 Using Credits

Credits are deducted from your balance when you initiate a scan. The cost of each scan depends on the number of keywords and grid points selected. A standard scan with 3 keywords and 21 grid points costs $5.00 in credits. Credits are non-transferable between accounts.

3.3 Credit Expiration

Purchased credits do not expire and remain available in your account until used or until your account is terminated.

3.4 Refund Policy

Unused credits are generally non-refundable. However, if a scan fails to complete due to a technical error on our end, we will credit the full scan cost back to your account. For refund requests related to other circumstances, please contact us at support@gbpranktracker.com. Refund decisions are made at our sole discretion.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to scrape, harvest, or collect data for purposes unrelated to legitimate local SEO analysis.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools, bots, or scripts to interact with the Service beyond its intended interface.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any part of the Service or its related systems or networks.
• Use the Service to engage in any activity that violates any applicable law or regulation.
• Resell, sublicense, or redistribute the Service or its data without our prior written consent.
• Create multiple accounts to circumvent usage limits or abuse promotional offers.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by GBP Rank Tracker and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the Service (such as business names and keywords). By using the Service, you grant us a limited license to process this data solely to provide the Service to you. Scan results and reports generated by the Service may be used, shared, and published by you for your business purposes.

6. Data and Accuracy

The Service provides ranking data based on Google Maps search results at the time of scanning. Rankings can fluctuate due to factors outside our control, including Google algorithm changes, location-based personalization, and real-time updates. We make no guarantee that the data provided is 100% accurate or reflective of what every user will see. Scan results should be used as a general indicator of ranking performance, not as an absolute measure.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GBP RANK TRACKER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

9. Termination

You may terminate your account at any time by contacting us at support@gbpranktracker.com. Upon termination, your access to the Service will be revoked and your scan data will be deleted in accordance with our Privacy Policy.

We may suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or used the Service in a manner that could harm us or other users. In the event of termination for cause, any remaining credits in your account will be forfeited.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree to resolve the dispute in a court of competent jurisdiction.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
